Aetna has updated their policy on the Consolidated Appropriations Act (CAA) gag clause provision.
Your clients received a notice from Aetna stating they are responsible for submitting the Gag Clause Prohibition Compliance Attestation. However, based on recent market intelligence and feedback from the broker/consultant community, Aetna has reassessed their approach for fully-insured and small group AFA plan sponsors.
Aetna will submit the Gag Clause Prohibition Compliance Attestation on behalf of all fully-insured and small group AFA plan sponsors. In order to submit the attestation, Aetna is evaluating the completeness and accuracy of plan sponsor contact information they have in their systems. In the event Aetna does not have complete information, they will be requesting assistance from the Account Management teams to collect and update the required data.
