As part of the Consolidated Appropriations Act (CAA), 2021 (H.R. 133), the No Surprises Act (the “Act”) promotes transparency of health care costs and consumer protection by requiring providers, health plans and others to provide consumers with information regarding their prices and fees.
For group health plans, the CAA Section 202 requires brokers and consultants to disclose to their Commercial clients the direct, and indirect, compensation they have received and/or expect to receive for their services in excess of $1,000.00.
The Act provides general guidance about the content of the disclosures and does not provide guidance about the format. Agents, Brokers, and Consultants have latitude to develop the format they wish to use to make their disclosures. Your compensation from Health Net will vary depending on your market, customers, and may be in the form of commissions, incentives, special agreements and/or non-monetary compensation.
This disclosure must occur prior to the Commercial health plan client contracting for health plan coverage with Health Net during the next plan year. The compensation disclosure requirements for both the Commercial plans are effective for contracts entered into, renewed, or extended on or after December 27, 2021.
