As you may be aware, the Consolidated Appropriations Act of 2021 prohibits gag clauses in contracts between insurance plans, insurance issuers and providers. Health plans are required to attest to their compliance with the law by Dec. 31, 2023, through a Gag Clause Prohibition Compliance Attestation to the Centers for Medicare & Medicaid Services (CMS).
Sutter Health Plus filed their first attestation to the CMS in October 2023 and will file an attestation annually. There is no action required from their brokers or employer groups.
