The White House originally announced that it intends to end both the national and public health emergencies on May 11, 2023.

This will end three (3) years of COVID-related relief requiring group health plans to cover COVID diagnostic testing and vaccines, and extending deadlines normally applicable under ERISA, COBRA, and HIPAA. The end of the public health emergency also allows states to begin to recertify Medicaid eligibility. Employers need to be prepared for some of their employee’s losing Medicaid eligibility and qualifying for a HIPAA special enrollment opportunity to join the employer’s health plan. Finally, the change to the definition of affordability for family coverage has the potential to create significant changes in family enrollment on employer plans.
