Senators Rob Portman (R-OH) and Mark R. Warner (D-VA) reintroduced S. 2366 to reform the ACA’s employer reporting requirements. Rep. Mike Thompson (D-CA) introduced companion legislation in the House (H.R. 4070).
Currently, employers and insurers must report health insurance coverage information to the IRS at the end of the tax year, which creates a heavy back-end burden for employers. The reporting requirements can also lead to discrepancies resulting in IRS tax penalties along with additional compliance costs and burdens.
The Commonsense Reporting Act of 2019 would allow the following regarding IRS reporting:
• Reporting health plan information before open enrollment
• Electronic transmission of employee and enrollee statements
• Submission of full names and birth dates for dependents and spouses instead of Social Security numbers
